Policy Statement

All employees of Adelphi University, except for those exceptions described below, are employed on an “at will” basis.

Reason for Policy

The purpose of this policy is to define the “at will” employment relationship between the University and its at will employees.

Who Is Governed by this Policy

Non-Union Employees

Policy

All non-union employees, including full-time, part-time, hourly, student and temporary employees, are deemed to be employees at-will. All full-time and part-time non-union employees are informed in their Appointment Letter that employment at Adelphi is deemed to be employment at-will and is for no definite time period. An employee’s appointment can be terminated either by the employee or by the University at any time, for any reason, and without regard to cause.

The status of union employees is determined by the applicable collective bargaining agreement.

The at-will statement is included within the Appointment Letter and provided to full-time and part-time employees upon the time of the offer of employment.

Definitions

At-will employment is a term used in U.S. labor law for employment relationships in which an employee can be dismissed by an employer for any reason (that is, without having to establish “just cause” for termination), other than reasons prohibited by applicable law, and without warning.
